Kagan's Furniture has been working with customers from all parts
of the United States, Asia, the Middle East and beyond. Our customers
from our home state of North Carolina receive the same great values
and services as do our customers from New York, Florida, California
and everywhere in between.
- A 50% deposit is required at the time of sale.
The balance is due when you are notified your furniture is in
our warehouse. The balance must be paid with a certified
check, cashiers check, bank money order or cash. There
will be a $30.00 charge for any returned checks.

- If we do not receive payment in full within 15
days after notification your furniture has been received in our
warehouse, your deposit will be forfeited and your furniture will
be put in our stock for resale.
- On orders that are split shipped, we require full
payment for those items being shipped and a 50% deposit must be
left on the remaining order.
- Request for cancellations will be accepted subject
to our ability to cancel with the manufacturer. NO
cancellations accepted after fabric has been cut or shipment made
by the manufacturer. Providing the order can be cancelled,
your deposit will be refunded less a $50.00 special handling
charge. Failure to accept any order that cannot be cancelled
will result in a forfeiture of your deposit.
- All furniture sold by this contract is sold
with a manufacturers' warranty only. In case of dissatisfaction,
Kagan's will contact the manufacturer about the problem, and Kagan's
will do as instructed by the manufacturer for resolving the problem.
In case of manufacturer's request to inspect or to return defective
furniture, it is the customer's responsibility to return the furniture
to Kagan's warehouse. Manufacturers do not guarantee fabrics
against wear or color fastness. All disputes arising out
of underlying agreement shall be arbitrated or litigated in the
county of the showroom location. All legal expenses that
are a result of actions taken by any of the parties involved are
to be paid by the customer.
- If customer chooses to pick up his/her furniture
at Kagan's warehouse, the customer will be required to pay North
Carolina sales tax regardless of state of residence. All
furniture must be inspected prior to loading on customer's truck.
Kagan's shall no be responsible for freight charges and freight
damages.
Kagan's
Furniture, Inc. is not responsible for delays in delivery due
to fault of the delivering carrier or manufacturing delays.
Deliveries shall be subject to, and contingent upon, strikes,
labor difficulties, riot, war, fire, delay or faults of common
carriers, failure of curtailment in the Seller's usual sources
of supply, government decrees or orders, or, without limiting
the foregoing, any other delays beyond the Seller's reasonable
control, and the Seller shall not be liable for any loss or damage
arising therefrom. The Seller shall have the additional
right in the event of the happening or any of the above contingencies,
at its option, to cancel this Contract or any part thereof, without
any resulting liability. Any delivery not in dispute shall
be paid for regardless of other controversies relating to other
delivered or undelivered merchandise. Delivery dates and
times of goods purchased and sold under this Contract are subject
to change without notice, and Kagan's Furniture, Inc. DOES
NOT guarantee a date of delivery of the goods sold hereunder,
and delay in delivery shall not void this Contract.
- Responsibility for transit damage resets upon the
delivery carrier. In the event of damage, the shipper will
have the furniture repaired to 100% factory quality, or at the
shipper's discretion, will replace only those items which cannot
be properly repaired. The customer contracts Kagan's only
for the purpose of purchasing the furniture. The carrier
is contracted by the customer to deliver the furniture to the
customer's home. All delivery fees will be paid by the customer
directly to the carrier. All shipping matters before and
after the delivery (as, but not only: fees, damages or scheduling)
shall be discussed by the customer directly with the delivery
service company.
- PLEASE inspect each piece BEFORE the driver
leaves. WE RECOMMEND that anything received with
obvious damage or manufacturing defect, be refused by you before
the driver leaves. Only refuse the damaged item(s), NOT
the entire shipment. If freight damage or manufacturing
defect is discovered after carrier leaves, the customer is considered
liable for repairs as well as the pick-up and re-delivery fee.
Kagan's Furniture, Inc. nor the delivery company
will be liable after the delivery carrier leaves your home.
- Kagan's Furniture, Inc. will not be responsible
for furniture ordered or delivered which does not fit into your
home or areas of anticipated use.
- Any merchandise sold from our sales floor is sold
as a Final Sale, As-Is, no refunds, no warranties, no returns
unless noted otherwise by a sales manager.
- This Order contains the Entire Agreement between
the parties and cannot be changed or terminated orally.
- Merchandise marked "Partial Assembly Required,"
"Assembly Required" or any note of the like is delivered in factory
packed cartons for assembly by Purchaser.
- ACCEPTANCE OF TERMS: CUSTOMER HAS SEVEN(7) DAYS
AFTER WRITING THIS SALES ORDER TO CONTACT KAGAN'S FURNITURE,
INC. IN WRITING AND BY REGISTERED MAIL, CONCERNING ANY QUESTIONS
REGARDING THE ABOVE. AFTER SEVEN (7) DAYS THE BUYER WILL
BE BOUND BY ALL OF THE TERMS, CONDITIONS, AND SPECIFICATIONS OF
THIS ORDER.
